These terms govern your use of Nesmori. Nesmori is operated by Nesmori LLC, an Illinois limited liability company. By creating an account or using the service, you agree to them.
What Nesmori is
Nesmori is a shopping assistant. You describe what you are looking for; we search across retailers, compare options, and link you to retailers where you can buy. Nesmori is not a store: we do not sell, stock, ship, or warrant any product. Every purchase happens on the retailer’s own site, under the retailer’s terms, prices, and policies.
Private alpha
Nesmori is in private alpha. Access is granted individually and may be limited, changed, or paused while we refine the service. Features may change or be removed without notice during this period.
Your account
You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. You must be at least 13 years old to use Nesmori.
Acceptable use
- Don’t break, probe, or overload the service, or access it by automated means without our permission.
- Don’t use Nesmori to violate the law or the rights of others.
- Don’t resell or redistribute the service or its data without our written consent.
Prices, availability, and product information
Prices, availability, coupons, and product details shown on Nesmori come from retailers and data partners and can change or contain errors. The price that governs is the one on the retailer’s site at checkout. We work to keep comparisons accurate, but we make no guarantee that any listing is current, complete, or error-free.
Sellers
Nesmori lists offers from many retailers we do not control. We run automated and manual checks on the stores we link to, and we may add a warning to, or remove, any seller that we cannot verify or that we believe is fraudulent, counterfeit, or unsafe. A warning is information, not a finding of wrongdoing, and the absence of a warning is not a guarantee. We make no promise that any seller we link to is legitimate, and we may remove listings, saved items, or alerts that reference a removed seller. If we remove a seller you clicked through to or saved, we may email you so you can take precautions. How we check sellers is described on our How we vet sellers page.
Affiliate links
Some links on Nesmori are affiliate links: if you buy after clicking one, the retailer may pay us a commission at no additional cost to you. Commissions never affect our ranking or the price you pay. See the Affiliate Disclosure.
Intellectual property
Nesmori, its design, and its content (excluding retailer product information and trademarks, which belong to their owners) are ours and protected by law. We grant you a personal, non-exclusive, non-transferable right to use the service.
Feedback
If you send us feedback or suggestions, you agree we may use them without restriction or obligation to you.
Disclaimers
Nesmori is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We are not a party to any transaction between you and a retailer and are not responsible for the products, services, or conduct of retailers or affiliate networks.
Limitation of liability
To the fullest extent permitted by law, Nesmori and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the service. Our total liability for any claim relating to the service will not exceed one hundred US dollars ($100).
Indemnification
You agree to indemnify and hold harmless Nesmori LLC and its managers, members, and service providers from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the service in violation of these terms or of the law, or from any transaction between you and a retailer.
Termination
You may stop using Nesmori and delete your account at any time. We may suspend or end access to the service (including during the private alpha) where reasonably necessary — for example, for breach of these terms or to protect the service.
Changes to these terms
We may update these terms; the date above reflects the latest revision. For material changes we will tell account holders by email. Continued use after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Illinois and applicable United States federal law, without regard to conflict-of-law rules.
