These terms govern your use of Nesmori. Nesmori is operated by Nesmori LLC, an Illinois limited liability company. By creating an account or using the service, you agree to them.
What Nesmori is
Nesmori is a shopping assistant. You describe what you are looking for; we search across retailers, compare options, and link you to retailers where you can buy. Nesmori is not a store: we do not sell, stock, ship, or warrant any product. Every purchase happens on the retailer’s own site, under the retailer’s terms, prices, and policies.
Price watching
We check prices on the items in your nests nightly, on a best-effort basis: a night’s check can be missed or incomplete, and a price we show or email you may have changed by the time you see it. Under fair use, each account’s price watching covers up to 200 items at a time; items beyond that stay saved in your nests but are not price-checked. Price checks pause for the items in a nest you haven’t added to or changed in 90 days, and start again when you do. We may change the 200-item ceiling, but we won’t lower it below the number of items an account is already watching.
Your account
You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. You must be at least 13 years old to use Nesmori. If you are under 18 and a parent or guardian has not given consent through your app store, we will not enforce these terms against you.
Acceptable use
- Don’t break, probe, or overload the service, or access it by automated means without our permission.
- Don’t use Nesmori to violate the law or the rights of others.
- Don’t resell or redistribute the service or its data without our written consent.
Prices, availability, and product information
Prices, availability, coupons, and product details shown on Nesmori come from retailers and data partners and can change or contain errors. The price that governs is the one on the retailer’s site at checkout. We work to keep comparisons accurate, but we make no guarantee that any listing is current, complete, or error-free.
Sellers
Nesmori lists offers from many retailers we do not control. We run automated and manual checks on the stores we link to, and we may add a warning to, or remove, any seller that we cannot verify or that we believe is fraudulent, counterfeit, or unsafe. A warning is information, not a finding of wrongdoing, and the absence of a warning is not a guarantee. We make no promise that any seller we link to is legitimate, and we may remove listings, saved items, or alerts that reference a removed seller. If we remove a seller you clicked through to or saved, we may email you so you can take precautions. How we check sellers is described on our How we vet sellers page.
Affiliate links
Some links on Nesmori are affiliate links: if you buy after clicking one, the retailer may pay us a commission at no additional cost to you. Commissions never affect the price you pay. They affect our ranking in one case only: when two stores charge exactly the same price, the store that pays us a commission is listed first. See the Affiliate Disclosure.
Intellectual property
Nesmori, its design, and its content (excluding retailer product information and trademarks, which belong to their owners) are ours and protected by law. We grant you a personal, non-exclusive, non-transferable right to use the service.
Feedback
If you send us feedback or suggestions, you agree we may use them without restriction or obligation to you.
Disclaimers
Nesmori is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We are not a party to any transaction between you and a retailer and are not responsible for the products, services, or conduct of retailers or affiliate networks.
Limitation of liability
To the fullest extent permitted by law, Nesmori and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the service. Our total liability for any claim relating to the service will not exceed one hundred US dollars ($100).
Indemnification
You agree to indemnify and hold harmless Nesmori LLC and its managers, members, and service providers from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the service in violation of these terms or of the law, or from any transaction between you and a retailer.
Termination
You may stop using Nesmori and delete your account at any time. We may suspend or end access to the service where reasonably necessary — for example, for breach of these terms or to protect the service.
Changes to the service
We change Nesmori often, and we may add, change, or remove features at any time without notice.
Changes to these terms
We may update these terms. When we do, we update this page and the date above. Continued use after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Illinois and applicable United States federal law, without regard to conflict-of-law rules. Any dispute that arises from these terms or from your use of Nesmori will be heard in the state or federal courts located in Cook County, Illinois, and you and Nesmori LLC each agree to the jurisdiction of those courts. Nothing here takes away a consumer protection that the law of your home state gives you and does not allow you to waive.
